Land broker Kamoga survives jail, faces arrest

Land broker, Muhammad Kamoga have survived arrest from Entebbe Chief Magistrates Court after he was steal fully whisked away.

At the Entebbe based court, a group of bailiffs and police officers armed with an arrest warrant had waited to arrest Kamoga after his intended court session.

Witnesses said that Kamoga was only tipped by a member of his group forcing him escape from court with his lawyer.

According to the arrest warrant issued by the Land Division of the High Court, Kamoga is wanted regarding a fraudulent land dealing on a 16 acre land at Bukaaya.

Kamoga is wanted jointly with a one Fredrick Kwatakunsawo Ssengooba Kiwanuka is also on the run since 2018.

“… to fulfill his obligations as ordered by the decree and whereas the said Muhammad Kamoga and Fredrick Kwatakunsawo have not fulfilled his obligations as ordered by the decree of this court dated August 31, 2018,” reads the court order.

The court order reads: “this to command you to arrest the said judgment debtors unless the said judgment debtors (Kamoga and Kwatakunsawo) and bring them before court with th convenient speed,”

 

Kamoga of the defunct M/s Kamoga property consultants has come to the court to answer accusations of fraud and forgery regarding transfer of a 200 acre land at Garuga, Bukaya Entebbe in Wakiso District.

Bugingo Andrew Nganda, the complaint against Kamoga said that the land broker has been eluding arrest since 2018.

According to Bugingo, the broker fraudulently transferred his title into his name before sub dividing it for sale and also donated part for construction of the mosque.

The Cheif Magistrates Court at Entebbe had set March 28, 2025 for Kamoga to appear and answer charges of fraud, forgery, unlawful eviction and malicious destruction of property.

Kamoga is alleged to have forged the signatures of Peter Bibangamba on transfer forms for land at Bukaya, Entebbe thereby fraudulently acquiring registration on the same land.

He is accused of uttering false documents, unlawful eviction and malicious damage to property.

Kamoga’s woes started from allegations that he used forged transfer forms to unlawfully transfer land ownership from Peter Bibangamba into his names for more than 200 acres at Bukaya in Wakiso District.

The trial date was set after the Court of Appeal overturned a 2024 High Court ruling that had halted Kamoga’s prosecution.

In October 2024, the justices of the Court of Appeal ruled in favor of the Director of Public Prosecutions who successfully challenged the High Court’s decision that had stayed the criminal proceedings aganist Kamoga.

The justices held that the High Court lacked jurisdiction to stop Kamoga’s trial, declaring that the High Court decision illegal.

The court futher held that Kamoga had no right in law to petition the High Court for an Order of stay of criminal proceedings agamist him which were ongoing at Entebbe Chief Magistrates Court.

Consequently, the Court of Appeal unanimously quashed a High Court order that had stopped the prosecution of Kamoga on grounds that that the lower court had erroneously stayed the fraud criminal proceedings thereby occasioning a miscarriage of justice.

 

“…This is a valid reason why the trial judge ought not to have stayed the criminal proceedings. If a party commits a crime in pursuit of its civil rights, he or she can still be prosecuted. If one alleges that the transfer instrument was forged, investigation and prosecution of the culprit should continue,” the court held.

The Court of Appeal’s decision paved the way for the resumption of the trial of Kamoga at the Entebbe magistrate Court.

Kamoga faces two separate case files.

In the first case file, he is charged with six counts of forgery, uttering false documents, and obtaining land registration fraudulently.

It is alleged that between May 7, 2020, and February 8, 2021, at the Wakiso land offices, Kamoga forged the signature of Peter Bibangamba on land transfer forms for Busiro Block 435, Plot 8, and 100 other plots measuring over 200 acres fraudulently claiming that they had been signed by Peter Bibangamba, whereas not.

He is also charged with uttering forged transfer forms to the offices of Wakiso land office and obtaining registration on land comprised in Busiro Block 435 Plot 8 and 100 other plots fraudulently.

The second case file involves charges of unlawful eviction and malicious damage to property where Kamoga is alledged to have evicted people from the same land and maliciously damaged their property on February 19 and 20, 2021.

In September 2023, Mr Kamoga was charged with multiple counts of forgery and uttering a false document and obtaining registration by false pretense.

The charges are in connection with the alleged fraudulent acquisition of ownership of a 200 acre land on two villages of Bukaya and Bugoba – Garuga, in Katabi Town Council, Wakiso District, the land belonging to Mr Peter Bibangamba.
